In 2008, the General Assembly passed legislation to revise the procedures used when the county commission fills a
vacancy in a county office. The link below will take you to a document drafted by CTAS attorney Kristy Brown that
explains the changes made by the new law. These new statutes are now effective and apply to vacancies currently
before the county commission for consideration.

drafted by UT CTAS. Many counties operate in accordance with Robert Rules of Order. If you are interested in a set
of rules more specifically designed for the functions of a county commission, you may want to consider these rules.

Annually, the Division of Solid waste Management, Tennessee Department of
Environment and Conservation (TDEC) produces an updated list of all permit
modifications of facilities permitted to treat, store, or dispose of hazardous waste in
Tennessee that were approved from during a given calendar year. Below you will
find links to these reports for recent years.

This year, after major flooding impacted over half of Tennessee’s counties, the General Assembly enacted several tax relief provisions for flood victims. One of the provisions enacted authorizes local governments to provide a measure of relief through the property tax appraisal process. This link connects you to an electronic copy of a packet of information mailed to Assessors of Property and County Mayors of the 49 counties included in the FEMA flood disaster declaration. It contains a memorandum from the Division of Property Assessments summarizing the special legislation on proration of the properties affected by the floods and the roles and responsibilities of entities administering those assessments. This is a local option tax relief provision and will only take affect if adopted by a 2/3 vote of the governing body. The link also includes attachments such as copies of the legislation, a FEMA map of affected jurisdictions, a sample resolution developed by CTAS, and a sample application.

Next year, all county commissions in Tennessee will be required to examine the results of the 2010 census and reapportion districts in the county to maintain substantially equal representation across districts. During a breakout session at the TCSA Fall Conference, staff from the Comptroller’s Office presented some preliminary information and discussed the process counties will go through next year. Below you will find a link to the power point presentation given as a part of the class.
